E-3 Australian Employee in a Specialty Occupation

E-3 status provides work authorization for Australian nationals who are employed by OSU in a position that requires at least a bachelor’s degree in a specialized field. 

In order to be eligible for OSU immigration sponsorship in E-3 status, both the OSU position and the employee must meet the requirements for E-3 status. 

What Positions are Eligible?

The position must:

  • Require at least a bachelor’s degree in a specialized field
  • Meet the minimum salary set by the Department of Labor for the occupation

Who is Eligible?

The prospective employee must:

  • Be a national of Australia
  • Possess the degree required by the OSU position

Length of Status

E-3 status has no mandated maximum length, and is authorized in increments of up to 2 years at a time.

Other Considerations

E-3 employment authorization is specific to the position for which the work authorization is granted.  OSU cannot change an E-3 employee’s position without updating the E-3 immigration work authorization first.

Family members of an E-3 employee can come to the US in E-3D status. Spouses of E-3 employees (in E-3D status) may work in the US after receiving work authorization documentation from the Immigration Service.
